Terms of Service

These Terms of Service ("Terms") govern your use of the GMZBST Games Feed self-service subscription (the "Service"), operated by GameZBoost (Pty) Ltd trading as GMZBST ("GMZBST", "we", "us"), a company registered in the Republic of South Africa. By creating an account and subscribing, you agree to these Terms.

1. The Service

The Service gives you access to a catalogue of HTML5 games that you can embed on your own website, blog or app via a link, iframe or the provided widget, together with a dashboard, branding options and load analytics. Games and creative assets are provided by GMZBST and its licensors.

2. Your account

• You must provide accurate signup details and keep your login secure. You are responsible for activity under your account.
• One login controls your account and its deployments. You may not resell or sub-license the Service without our written agreement.

3. Subscriptions, billing and renewals

• Plans are billed monthly in advance in US Dollars through PayPal, and renew automatically each month until cancelled.
• There is no setup fee. Prices shown are the total payable (inclusive of VAT where applicable).
• Each plan includes a monthly game-load allowance (your tier). We may change plan pricing from time to time; existing subscribers will be given reasonable notice before a change affects them.
• If a renewal payment fails, we may retry and, if it remains unpaid, suspend the Service.

4. Game-load allowance and fair use

Your tier sets a monthly game-load allowance. We count genuine plays and exclude obvious bot traffic and rapid repeats. If you approach your allowance we will notify you; we will not cut your games off mid-month for exceeding it, but sustained overage means you should move to a larger tier. We may contact you about upgrading for consistently high usage.

5. Cancellation and refunds

• You can cancel any time from your dashboard. Your games keep running until the end of the period you have already paid for, then stop.
• Monthly fees are non-refundable for partial periods. Refunds are otherwise at our reasonable discretion.

6. Acceptable use

You may not use the Service on sites that are unlawful, infringing, or that contain adult, hateful or otherwise harmful content, nor attempt to interfere with, overload, scrape or reverse-engineer the Service. We may suspend or terminate accounts that breach this section.

7. Intellectual property

The games, assets, software and branding remain the property of GMZBST and its licensors. While your subscription is active you have a limited, non-exclusive, non-transferable licence to embed and display the games you enable on your own sites. Your own logo and content remain yours.

8. Availability

We aim for high availability but the self-service Service is provided without a formal uptime guarantee. We may perform maintenance and may modify or discontinue features with reasonable notice.

9. Suspension and termination

We may suspend or terminate the Service for non-payment, breach of these Terms, or misuse. You may stop using the Service at any time by cancelling.

10. Disclaimers and liability

The Service is provided "as is". To the extent permitted by law, GMZBST is not liable for indirect or consequential loss, and our total liability in connection with the Service is limited to the fees you paid in the three months before the event giving rise to the claim. Nothing in these Terms limits liability that cannot be limited by law.

11. Changes to these Terms

We may update these Terms. We will post the updated version here and, for material changes, give reasonable notice. Continued use after a change means you accept the updated Terms.

12. Governing law

These Terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction.
